Goods supplied are based upon the written, verbal or other communication from the Customer.
The Customer is solely responsible for determining that the ordered Goods are suitable for the purpose for which the Goods are purchased.
We accept no responsibility for parts incorrectly supplied unless the engine and chassis number to properly identify the vehicle are quoted at the time of ordering.
Payment for goods will be accepted in Cash, Mastercard, Visa Card, American Express and Paypal, or by 30 day settlement for approved account holders for which Company cheques are acceptable.
We do not accept personal cheques. Any dishonoured cheques will incur any bank charges and fees.
A surcharge of 4% applies for American Express and Paypal. Electronic funds transfer is also acceptable if paid in advance a minimum of 2 days prior or more.
The Customer acknowledges that any provisional Delivery Date and or time specified by Euro Car Parts Pty. Limited at the time of Order is an estimate only and should Euro Car Parts Pty. Limited or any of it’s agents be unable to deliver the Goods by that date then delivery of the Goods shall be extended by any amount of time deemed necessary by Euro Car Parts Pty. Limited.
Euro Car Parts Pty. Limited may at its sole discretion cancel any Order, in which case any amounts paid by the Customer shall be refunded in full.
Loss or damage of goods in transit is at the purchaser’s risk unless the goods are covered by insurance paid by customer at the time of ordering.
Visible damage or loss must be clearly noted on carrier’s delivery receipts. Claims must be made on the appropriate carrier or insurance company within 48 hours by advising our office.
(a) Goods not required must be returned in original condition and packaging to Euro Car Parts Pty. Limited within 7 days at the expense of the purchaser.
(b) A copy of the original invoice is to be presented with any goods returned, accompanied with a reason written on the invoice why the said Goods supplied have been returned.
(c) All returns of Goods are subject to a 20% handling/restocking fee, with the exception of incorrectly supplied Goods.
(d) Any Goods supplied by Euro Car Parts Pty. Limited that are returned and have been fitted, painted or damaged, will not be acceptable for return or credit.
(e) For all local deliveries, the Customer will be liable for any delivery or pickup charges incurred by Euro Car Parts Pty Limited for all incorrectly ordered Goods, or for Goods no longer required.
(f) For all outer metropolitan and interstate deliveries, the following applies for any Goods supplied by Euro Car Parts Pty Limited that require to be returned for any reason ;
(i) Under no circumstances are goods to be returned via the courier that has just delivered the goods, or by any other courier, otherwise the purchaser or receiver of the goods will be liable for all costs incurred.
(ii) Any Goods required to be returned must have an RA number (Return Authorisation) with authorisation by Euro Car Parts Pty. Limited to use their nominated courier. Unless these procedures are adhered to, Euro Car Parts Pty Limited will not be liable for any freight charges incurred
(iii) The customer can choose to use their own courier at their own expense to return goods to Euro Car Parts Pty. Limited as well as adhering to point (2) in this section.
(g) Specially ordered parts and electrical items are not returnable for credit.
Not withstanding that the Customer has possession of the Goods, property in and ownership of the Goods remains with Euro Car Parts Pty Limited.
No legal or equitable interest or property in the Goods whatsoever shall pass to or vest in the Customer until the full amount due for the Goods and all other Goods supplied by Euro Car Parts Pty Limited to the Customer (including any additional amounts payable by the Customer pursuant to these Terms has been paid to Euro Car Parts Pty Limited by the Customer.
Until property passes to the Customer:
(a) The Customer holds the Goods as fiduciary and bailee for Euro Car Parts Pty Limited;
(b) The Goods must be stored separately and in a manner that enables them to be identified and cross-referenced to any particular Invoices in question;
(c) Euro Car Parts Pty Limited, its employees or agents, are entitled to enter the Customer’s premises between 9.00am and 5.00pm on any business day to inspect the Goods;
(d) In the event that the Customer is in default of its obligations under these Terms, any Order or any other agreement thatexists between the Customer and Euro Car Parts Pty Limited, the Customer must at its sole expense, deliver the Goods to Euro Car Parts Pty Limited on demand.
(e) If the Customer does not comply with such a demand, the Customer authorises Euro Car Parts Pty Limited to enter the Customer’s premises at any time to do all things necessary in order to take possession of the Goods. For this purpose the Customer must procure the consent of all other persons having any interest in the premises where the Goods are situated to entry of those premises by Euro Car Parts Pty Limited, its employees or agents and the Customer indemnifies Euro Car Parts Pty Limited against any claim, loss, liability, cost and expense that may be incurred or sustained by Euro Car Parts Pty Limited, its employees or agents, as a result of the entry of those premises where the Goods are situated.
(f) The Customer’s right to hold and sell the Goods will immediately cease if an Insolvency Event occurs in respect of the Customer. In any such case, and without the need for notice or demand by Euro Car Parts Pty Limited, the Customer acknowledges any sale of the Goods will not be in the ordinary course of the Customer’s business and the proceeds of any Goods sold in such circumstances will be held on trust for Euro Car Parts Pty Limited by the administrator, controller or similar officer as the case may be, or if there is no such officer, by the Customer.
(g) The Customer acknowledges that Euro Car Parts Pty Limited has a ‘Security Interest’ (as that term is defined in the Personal Property Securities (PPS) Act 2009) in all Goods and services supplied pursuant to these Terms and the Customer shall, if required by Euro Car Parts Pty Limited, assist Euro Car Parts Pty Limited in any way necessary to ensure that the Security Interest becomes a ‘Perfected Security Interest’ as that term is defined in the PPS Act.
Euro Car Parts Pty. Limited retains the ownership of all goods supplied until paid in full by the customer/buyer and no legal or equitable interest or property in the Goods whatsoever shall pass onto, or vest in the Customer until the full amount due for the Goods including any additional amounts to be payable by the Customer pursuant to these Terms)
If the Customer defaults in the payment of any sum of money due to Euro Car Parts Pty Limited, breaches these Terms or becomes insolvent, the following will apply;
(1) Where money is owed to Euro Car Parts Pty Limited, the Customer must pay to Euro Car Parts Pty Limited interest at the rate of 10% per annum calculated daily from the delivery date of goods until the date of payment in full of the Invoice amount;
(2) The Customer must pay or reimburse Euro Car Parts Pty Limited for any costs incurred to collect any monies owed including couriers costs, all collection agency costs incurred, and also any legal costs incurred byEuro Car Parts Pty Limited calculated on a solicitor and own client basis and any other administrative costs incurred by Euro Car Parts Pty Limited arising directly or indirectly from such default;
(3) Euro Car Parts Pty Limited may suspend all further deliveries of goods to the Customer (without prejudice) until any and all outstanding amounts are paid in full, including any interest or other sums payable under this clause.
(4) The whole sum then owing by the Customer to Euro Car Parts Pty Limited for all Goods sold by Euro Car Parts Pty Limited to the Customer, shall immediately become due and payable and the Customer shall not thereafter be entitled to purchase Goods on credit from Euro Car Parts Pty Limited unless agreed in writing by both parties.
All new parts supplied carry a 12 month warranty on parts only.
Euro Car Parts Pty Limited will not be liable for any consequential loss, damage, or loss of income because of the failure of goods sold.

Reconditioned Parts – 12 months parts and labour warranty.
All used parts supplied carry a 3 month warranty on parts only and are subject to the below conditions ;
Warranty for major mechanical items will be void if there is a failure or defect caused by the following situations;
a) Improper installation or incorrect application.
b) Overheating or overloading.
c) Insufficient or incorrect use of oil/lubricants.
d) Failure to carry out correct maintenance.
e) Unauthorised repairs, alterations or dismantling.
f) Misuse, neglect or accidents.
Electrical and Fuel Parts
If an item is returned as faulty, a replacement will be issued or delivered to the purchaser. Any evidence of tampering or dismantling a supplied part which is subsequently returned as faulty will void warranty.
No refunds will be issued on electrical parts.
Engines and Gearboxes
Gearboxes are quoted and sold on an exchange basis.
Engines sold are supplied as “long bare”. For convenience, accessories may be left on but are not covered under warranty. It is recommended that the original accessories from the replaced Engine or Gearbox be used.
Euro Car Parts Pty Limited will not be liable for any unauthorised repairs without our written consent. Any repairs carried out without our written consent will be at the customer’s own expense.
In the event of any claim being denied, Euro Car Parts Pty Limited reserves the right to recover any out of pocket expenses incurred. Reimbursement by the customer will be required prior to Euro Car Parts Pty Limited returning the unit.
In the event of any signs of malfunction, it is the customer’s responsibility to cease operation and advise Euro Car Parts Pty Limited as soon as possible. Failure to comply may result in damage to your vehicle, and void any warranty.
